Commercial Electronic Message Notice

This notice explains, under Personal Data Protection Law no. 6698 ("KVKK"), how the personal data given to us for the purpose of sending commercial electronic messages and establishing commercial electronic communication is processed.

What Is a Commercial Electronic Message?

Under Law no. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, a commercial electronic message is data, sound and image content sent for commercial purposes in an electronic environment using means such as telephone, call centres, fax, automatic dialling machines, smart voice recording systems, electronic mail and short message services.

Data Controller

Gym Strongers Yaşam ve Spor Merkezi Ticaret Limited Şirketi ("our Company") sends commercial electronic messages to recipients who have given consent, by means such as SMS, WhatsApp, e-mail, telephone and call centre, and thereby establishes commercial communication. Personal Data Processed

In order to send you commercial electronic messages and to establish commercial electronic communication with you, the name, date of birth, gender, mobile phone number and e-mail address you have shared with our Company, together with your preferences and survey answers, are processed by our Company as data controller for the purposes and on the legal bases set out in this notice.

Method of Collection

This personal data may be collected in written or electronic form, in compliance with the KVKK, through our website, our social media accounts, our club, our sales and marketing units, customer forms, digital marketing channels and contracts.

Purposes of Processing

Where consent has been given under Law no. 6563 and the related Regulation, your personal data may be processed for the following purposes:

  • Promoting all of our Company's products and services; conducting marketing, promotion and campaign processes
  • Informing you of campaigns and offers; providing prices, offers and information about our services
  • Communicating effectively with members and customers, conducting after-sales services and customer relations processes
  • Determining suitable membership types in line with usage habits, needs and preferences, and providing a personalised service
  • Sending personalised content, offers, celebrations and good wishes
  • Delivering and operationalising services effectively
  • Conducting marketing analysis and internal reporting processes
  • Monitoring and improving the systems through which services are provided
  • Fulfilling our Company's obligations arising from Law no. 6563 and the related Regulation

Legal Bases

Personal data relating to commercial electronic message processes is processed on the basis of explicit consent under Article 5/1 of the KVKK. In addition, on the grounds set out in Article 13 of the Regulation on Commercial Communication and Commercial Electronic Messages ("Burden of proof and record retention period"), this data is processed on the bases of Article 5/2-a ("expressly provided for in law") and Article 5/2-e ("necessary for the establishment, exercise or protection of a right") of the KVKK.

Transfers

Your personal data may be transferred to official authorities and institutions of any kind, to the Message Management System (İYS) as required by legislation, and to the software and service providers from which our Company obtains services in order to carry out its commercial electronic communication activities. Transfers abroad may only be made in compliance with the conditions set out in the KVKK and where your explicit consent exists.

Withdrawing Consent

You may refuse to receive commercial electronic messages at any time, free of charge. To do so you can use the opt-out link in the message you received, withdraw your permission through the Message Management System (İYS), or send an e-mail to info@gymstrongers.com. Your refusal request is actioned within three business days.

Your Rights under Article 11 of the KVKK

Under Article 11 of Law no. 6698 you may apply to our Company to exercise the following rights:

  • To learn whether your personal data is being processed
  • To request information if your personal data has been processed
  • To learn the purpose of processing and whether the data is used in line with that purpose
  • To know the third parties in Türkiye or abroad to whom your data has been transferred
  • To request correction if your personal data has been processed incompletely or incorrectly
  • To request deletion or destruction of your personal data under the conditions of Article 7 of the Law
  • To request that corrections and deletions be notified to the third parties to whom the data was transferred
  • To object to a result against you arising from analysis carried out solely by automated systems
  • To claim compensation if you suffer damage because your personal data was processed unlawfully

You can submit requests concerning these rights in writing to Körfez Mah. Atakum Bulv. No:4, 55270 Atakum / Samsun, or by e-mail to info@gymstrongers.com, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. Under Article 13 of Law no. 6698 your applications will be concluded free of charge within thirty (30) days at the latest. However, if the application requires an additional cost, the fee in the tariff set by the Personal Data Protection Board may be charged.
